The Delhi High Court on Monday quashed Doordarshan’s order dated April 16, 2009 blacklisting B.A.G. Films & Media Ltd. for two years.

The verdict of the High Court reaffirmed B.A.G. Films & Media Ltd.’s status as a leading 360 degree media company of India. It reinforced the fact that ethical business conduct cannot be overlooked and subverted for vested interests.

In its petition, B.A.G. Films had alleged that Prasar Bharati had acted in an ‘arbitrary manner’ and ‘without giving any reason’ for blacklisting the company on charges of submission of blank tapes. The Delhi High Court had on August 22, 2009 issued notices to Prasar Bharati and Doordarshan seeking sections or rules under which such action had been taken. The Hon’ble Court had also directed the pubcaster to provide the company another opportunity to explain its position.

However when the matter came up for hearing in the Court of Justice Sanjiv Khanna, on November 23, 2009, Mr Rajeev Nayyar, Senior Advocate pleading on behalf of B.A.G. Films & Media Ltd highlighted the fact that though Doordarshan did serve a fresh show cause notice and the same was replied to by B.A.G. Films, it had failed to act upon the response or provide adequate reason as to why such an extreme step was justified. The Court held that therefore the blacklisting order was unjustified and proceeded to quash the same.
